6. Principles of collection and processing of personal data

PIK Vrbovec plus d.o.o. collects and processes personal data respecting the positive principles of personal data processing prescribed by the General Data Protection Regulation, the Act on the Implementation of the General Data Protection Regulation, positive regulations of the Republic of Croatia and the Company’s internal acts governing the protection of personal data.

PIK Vrbovec plus d.o.o. is committed to the effort to collect and process only the personal data which the company is obliged to collect in compliance with legal obligations, which is necessary for the performance of contracts in which the data subject is a party or the data subject has given his consent to the processing of data for a specific purpose, or for which there is a legitimate interest of PIK Vrbovec plus d.o.o. for the processing of personal data, making sure that the rights and freedoms of the data subjects are not infringed, and that data processing is fair and transparent.

While collecting and processing personal data, all participants in the process are obliged to ensure that only that personal data is collected and processed which is appropriate and relevant for the purpose for which it is collected and limited only to what is necessary to achieve the purpose for which the personal data is collected and processed.

PIK Vrbovec plus d.o.o. takes all reasonable measures to ensure that the personal data collected and processed is accurate and up-to-date to the extent to which PIK Vrbovec plus d.o.o. has or can have information about data changes.

7. Delivery of data to third parties

PIK Vrbovec plus d.o.o. may transfer personal data to third-party recipients in the event of a legal obligation to deliver personal data based on national or international regulations or to protect the rights and interests of the Personal Data Controller to the extent prescribed or necessary to achieve the purpose for which the personal data is transferred. Such recipients are, for example, public or judicial authorities.

We may share your personal data with service providers who, based on special contracts, provide specific services and may also act as Data Processors.

PIK Vrbovec plus d.o.o. is part of the Fortenova Group d.d., and personal data may need to be transferred within the group for business purposes.

8. Personal Data Protection

PIK Vrbovec plus d.o.o. has implemented organizational and technical measures to ensure the security of personal data processing, including protection against unauthorized access to and processing of personal data and loss, destruction, or damage of personal data.

All employees with access to personal data are obliged to keep personal data confidential with a confidentiality statement that binds them indefinitely.

9. How do we collect personal data?

PIK Vrbovec plus d.o.o. collects personal data:

• directly from data subjects as part of contractual or other business relationships in which the data subject is the other party, regardless of the kind of relationship (employment, agreements with business partners, applications for job vacancies, etc.);
• from third parties based on legal obligations and powers;
• from publicly available sources (e.g. HZMO, HZZO, HZJZ, etc.).

10. Personal Data Storage Period

The period of storage of personal data is determined by mandatory regulations, internal acts or the purpose for which personal data is collected and processed.

In accordance with positive regulations, PIK Vrbovec plus d.o.o. is obliged to keep certain types of personal data as documentation of permanent value.

In all other cases, when positive regulations or internal acts specify a shorter period of storage of personal data, personal data is stored only as long as prescribed unless there is an obligation to store data for a longer period in the event of their exclusion due to the existence of a judicial or other process, in which case the data is kept until the end of the process.

If the storage period is not determined by mandatory regulation or internal acts, PIK Vrbovec plus d.o.o. strives to ensure that the data is kept in a form that enables the identification of the data subject only as long as is necessary to achieve the purpose for which the data is processed and that it is then deleted or destroyed in an appropriate manner.

11. What are the rights of data subjects, and who can I contact with questions about personal data protection?

Rights of data subjects:

• The right to access personal data – The data subject has the right to access their personal data that we process and may request detailed information, especially about the purpose of their processing, about the type/categories of personal data that are processed, including viewing the personal data, about recipients or categories of recipients, and about the expected period during which personal data will be stored. Access to personal data may be restricted only in cases prescribed by EU law or national legislation.
• The right to rectification of personal data – The data subject has the right to request that their personal data be rectified or completed if it is inaccurate, incomplete, or not up-to-date.
• Right to erasure – The data subject has the right to request the erasure of personal data if any of the requirements from Art. 17 of the General Data Protection Regulation are met.
• The right to limit the processing of personal data
• The right to object to the processing of personal data in accordance with Art. 21 of the General Data Protection Regulation are met.

• The right to submit a complaint to the supervisory authority – The data subject has the right to file a complaint to the Personal Data Protection Agency, Selska cesta 136, 10 000 Zagreb, azop@azop.hr, about the processing of personal data.

PIK Vrbovec plus d.o.o. shall inform the data subject about the actions taken without undue delay and no later than one month after receiving the request. Exceptionally, this deadline may be extended by an additional month if necessary, taking into account the complexity and number of requests, about which the data subject shall be informed.
